By accessing this website or purchasing a Garden Plan, you agree to the following terms.
Nature of the Service
Garden Plan provides digital Garden Plans intended as concept design guidance for residential gardens. These documents outline layout ideas, planting palettes, material suggestions, and general installation notes.
Garden Plans are:

concept design documents only

intended as a starting point for garden design and construction
They are not:

construction, engineering, or structural drawings

site surveys or inspections
-
planning or building permit documentation

a substitute for site-specific professional advice
Intellectual Property & Use of the Plans
All content, layouts, designs, text, images, drawings, and materials contained within a Garden Plan are the intellectual property of Garden Plan.
Purchase of a plan grants the buyer a limited, non-transferable licence for personal use only.
Permitted Use

The plan may be used solely for designing and constructing a garden on the buyer’s own property

The plan may be shared with a contractor or landscaper only for the purpose of building that garden
-
Contractors may reference the plan during construction of the buyer’s garden
Prohibited Use

The plan must not be copied, reproduced, redistributed, or resold

The plan must not be used for commercial projects or across multiple properties
-
Contractors must not retain, reuse, or distribute the plan for other projects
-
Any reproduction, in whole or in part, for resale, marketing, or other business activity is strictly prohibited
Site Conditions, Responsibility & Disclaimer
While care has been taken to ensure accuracy, Garden Plan is not responsible for site-specific conditions, soil conditions, underground services, council or planning requirements, or construction outcomes.
Garden Plans:

must not be submitted for planning or building approval

do not account for hidden services, contamination, structural conditions, or local constraints
The buyer is responsible for:

verifying site conditions and service locations
-
obtaining all required planning and building permits
-
ensuring compliance with all relevant local laws
-
engaging qualified and insured professionals where required
All construction work must comply with:

relevant South African Standard
-
local council regulations and approvals
If the buyer chooses to carry out works themselves, they do so entirely at their own risk.
Contractors & Third Parties
Garden Plan does not warrant or guarantee the performance of any contractors, trades, or suppliers engaged by the buyer.
Contractors may reference the plan solely for the purpose of constructing the buyer’s garden and must not retain or reuse the plan for other projects.
Digital Delivery & Refunds

All Garden Plan products are delivered digitally

Once a digital product has been accessed or downloaded, refunds are not available.

Limitation of Liability
To the fullest extent permitted by law, Garden Plan accepts no liability for any loss, injury, or damage to persons or property arising from the use, interpretation, or implementation of a Garden Plan, whether direct or consequential.
Garden Plan provides design information in good faith and makes no guarantee that the information contained within a plan is free from error. Garden Plan reserves the right to amend or update plan content at any time.
Governing Law
These terms are governed by the laws of South Africa, and any disputes will be subject to the jurisdiction of South African courts.
